The City of Chicago Municipal Ordinance for Public Urination is under section 8-4-081 titled:
Public urination or defecation:
Any person who urinates or defecates on the public way, or on any outdoor public property, or on any outdoor private property, shall be guilty of a misdemeanor and shall be fined not less than $100.00 nor more than $500.00, or incarcerated for no less than five days and no more than ten days, or both fined and incarcerated. This ordinance shall not apply to use of a temporary or permanent structure or enclosure erected outdoors for use as a toilet facility.
Here are a few tips when you’ve been charged with public urination.
If you were wrongly cited, fight the ticket!!
The Officers written description on the ticket suffices for sworn testimony. What that means in plain English is that the Officer who cited you does not have to be present in court for you to be found liable.
Any witnesses that can corraborate your story and back you up are always helpful.
The more witnesses the better.
Always attend your court date or send a representative.
This is a crucial point. If you ignore your court date a judgment can be found against you resulting in a $500 fine + $40 in court costs. It is always recommended that if you cannot appear have someone appear on your behalf.
