People of Illinois v B.A.

Defendant was arrested and charged for possession and distribution of controlled substances including cocaine and heroin after being observed by officers entering and exiting the home. Firearms were recovered from the home that was within 1000 ft of a school. A defendant with no criminal history was charged with 720 ILCS 570/402 and unlawful use of a weapon under 720 ILCS 5/24-1 and was facing a mandatory minimum prison sentence of 6 years.

Attorney Purav Bhatt, after questioning officers revealed that the State could not establish that Defendant lived at the home that was searched and none of the cocaine, heroin or firearms could be tied to Defendant.

All charges were dismissed.
