Charges: Possession of a Weapon by a Felon (720 ILCS 5/24-1.1)
Outcome: CASE DISMISSED – FINDING OF NOT GUILTY
Description: D.D. was present at a house party with approximately a dozen other people. Police forced their way into the apartment without a search warrant, under the rationale that they were in “hot pursuit” of suspects in a nearby armed robbery. Eight officers entered the apartment and a single officer stated he saw D.D. attempting to hide a gun in the oven. Only 1 of the 8 officers say they saw D.D. with the firearm but upon cross examination of the officers, no officer indicated that they were given notice that there was an individual in the apartment with a weapon. Officer who testified that he saw D.D. with the gun never notified any fellow officer that there was an armed suspect in the apartment.
